John P. DiBlasi, J.S.C. (Ret.) and NAM General Counsel, Jacqueline Silvey, Esq., have been invited by the American Bar Association (ABACLE) to present a live streaming CLE webinar Drafting the Arbitration Provision in Commercial Contracts. The presentation will be held virtually and open to the public on Tuesday, March 16th at 12:00 p.m. ET.
More and more cases are being submitted to arbitration as a result of pre-dispute contractual clauses. Sometimes, the clause is very basic and simply provides for arbitration in the event of a dispute. Join Judge DiBlasi and Ms. Silvey and learn how to create an arbitration clause that is detailed and specifies a variety of terms.
Attendees will receive insights and suggestions on crafting an arbitration clause, so as to avoid litigating the clause. They will also learn how to streamline the resolution of any dispute through its terms, crafting a clause applicable to a specific business transaction, and avoiding unconscionable terms that may be intertwined with ethical issues that could render the clause null and void in whole or in part.
Other topics to be discussed include:
- Crafting a clause, so as to prevent it from being litigated
- Avoiding challenges that could result in a severance of terms or a declaration that the clause is void
- Specific terms and their construction
- Reciprocal considerations and ethical issues
- The inclusion of a framework for the administration of this type of ADR process
About NAM's Presenters
Judge DiBlasi is the former presiding Justice of the Commercial Division of the Supreme Court of the State of New York. During his illustrious career, he has arbitrated and mediated over 3,000 cases with an ADR practice that centers on resolving Commercial, International, Finance, Employment, Entertainment, Land Use, and Professional Malpractice matters. In 2021, Judge DiBlasi was ranked a Top Three Mediator in the United States by The National Law Journal Annual Best of Survey for the eighth straight year (#1, 4 years in a row). He was also voted the #1 Mediator in the country by the 2019 Corporate Counsel Best of Survey for the second year in a row and for the third straight year, was named a National Law Journal Alternative Dispute Resolution Champion, as part of a select group of only 46 nationwide. Ms. Silvey, Esq. is General Counsel of NAM (National Arbitration and Mediation). She is involved in various management operations of the company including panel development, oversight and implementation of commercial and employment dispute resolution initiatives, the creation and implementation of various rules of procedure, and the general business affairs of the company. She also oversees neutral recruitment throughout the United States and internationally. Prior to joining NAM, Ms. Silvey was a Senior Litigation Associate and House Counsel for Chubb Insurance Company representing the carrier's corporate insureds under their respective Directors' and Officers' Liability policies. She has litigated in the Federal Courts, both Southern and Eastern Districts of New York, The New York State Courts and various city and state agencies. Ms. Silvey has been honored by the Long Island Business News with a 2020 Leadership in Law Award and recognized by the same publication as a 2020 Who's Who Women in Professional Services.
