Navigating the Mediation Experience

New York, NY (March 15, 2018) – NAM (National Arbitration and Mediation) is pleased to announce that an article written by the Honorable John P. DiBlasi entitled, Navigating the Mediation Experience: No Compromise – No Resolution, will be published on Monday, March 19, 2018 by the New York Law Journal as part of its Alternative Dispute Resolution (ADR) Special Report.
In the article, Judge DiBlasi draws from his years of experience as an attorney, jurist and neutral and presents his personal insights on how counsel can make best use of the mediator's abilities and time at every stage during the mediation process. With the ultimate goal of reaching a mutually agreed upon resolution – compromise is essential. The various stages discussed include: the pre-mediation teleconference, the pre-mediation brief, the joint session, the breakout session, the settlement and the continuance.
The breakout session is of particlular significance. It allows the mediator to meet the client, facilitate negotiations, evaluate the case and gain the client's acceptance. Hon. DiBlasi states, “Meeting the client is critical: it is the difference between reading a cold deposition transcript and witnessing live testimony.” Asking the client questions allows the mediator a fuller understanding of their position. “The mediator should not be like the Wizard of Oz, the invisible entity pulling all the levers. For the client, involving them in the process from the outset makes them feel included and heard.”
