Jeffrey A. Cohen (Ret.), Hon. Peter P. Skelos (Ret.), and James W. Borkowski, Esq., have been invited to present a live streaming continuing legal education (CLE) webinar, Inside the Mind of a Mediator: Avoiding Impasse and Maximizing Outcomes in Mediation. The presentation is part of a NYC Bar two-day 16-Hour Bridge-the-Gap Corporate & Litigation program. NAM's presentation is being held on Friday, January 21st beginning at 1p.m.
Our esteemed panel will discuss key issues in dispute resolution, with a focus on how to maximize outcomes, as well as avoid impasse in mediation. Judge Cohen, Judge Skelos and Mr. Borkowski will also provide best practices to help prevent the mediation from being sabotaged before real negotiations begin, as well as the latest tips, techniques and ethical guidelines counsel should consider throughout the mediation process.
About NAM's Presenters
Hon. Jeffrey A. Cohen (Ret.)
Justice Cohen served with distinction for over a decade as an Associate Justice of the Appellate Division, Second Department, New York. He handled cases that focused on commercial, contract, matrimonial, employment, labor law, election law, and real estate with regards to development/zoning issues, foreclosures and Article 78 proceedings. Based upon his experience both on the bench and as an attorney, he has garnered a vast amount of knowledge and experience in a variety of case types which include but are not limited to personal injury, slip and fall, auto accidents, premises liability, attorney malpractice, medical malpractice including nursing home litigation experience, high end matrimonial involving financial disputes and monetary distribution, construction and labor law, employment law including wage and hour, discrimination matters, wrongful termination, sexual harassment, and negligence.
Hon. Peter B. Skelos (Ret.)
Justice Skelos' career includes 11 years spent as an Associate Justice of the Appellate Division of the New York State Supreme Court, Second Judicial Department. Throughout his many years on the bench, he was known for having a keen legal intellect with compassion for those who appeared before him and is rated “Highly Qualified” by the New York State Independent Judicial Election Qualification Commission. Judge Skelos' experience both on the bench and in private practice, gives him a broad range of knowledge in numerous areas of the law including construction litigation, professional liability and insurance coverage disputes. In 2021, for the sixth year in a row, Judge Skelos was voted a Top Ten Neutral in the New York Law Journal Best Of Survey. He was also named a National Law Journal Alternative Dispute Resolution Champion, as part of a select group of only 46 nationwide. Judge Skelos is also Of Counsel to Forchelli Deegan Terrana LLP.
James W. Borkowski, Esq.
Mr. Borkowski's, distinguished career spans more than 30 years with a practice focused primarily on litigation at the trial and appellate levels in both the state and federal court systems. He has successfully represented insurance carriers, corporations and individuals in personal injury, construction, litigation, general liability, premises liability, property damage, automobile and commercial litigation (both plaintiff and defendant). Mr. Borkowski is well-known within the New York Metro area legal community, having served as lead trial counsel for hundreds of cases in nearly every county, and in all five boroughs of New York City. As a litigator, he developed an affinity towards ADR and counseled his broad clientele to consider this mechanism as a means towards finalizing time-consuming and costly litigation. In 2021, for the second year in a row, Mr. Borkowski was voted a Top 10 Arbitrator in the New York Law Journal Best of Survey.
