Join NAM neutral, Hon. Alan D. Scheinkman (Ret.) who will be joined by Rachel Allen, Esq. (Managing Attorney, Derek Smith Law Group PLLC), and Patrick Bannon, Esq. (Partner, Seyfarth Shaw) as they present, Working it Out – Effective Employment Dispute Resolution. This livestreamed CLE webinar will be held on Tuesday, May 23 at 1 p.m. ET by the New York State Academy of Trial Lawyers.
Our esteemed panel will discuss the various stages of an employment dispute and the consideration given to arbitration and/or mediation vs. pursuing litigation in the court system. Additionally, the session will address the benefits of alternative dispute resolution (ADR) and comparisons between ADR and court processes. Topics will include unique questions of law, difficult fact patterns, unusual evidentiary problems, and/or procedural challenges.

About the Presenters
Hon. Alan D. Scheinkman (Ret.) is a member of NAM's (National Arbitration and Mediation) Hearing Officer Panel. He is the former Presiding Justice of the Second Judicial Department of The New York State Supreme Court, Appellate Division, where he heard appeals in a wide variety of complex litigation matters that included business disputes, labor and employment partnerships, landlord and tenant, commercial foreclosure cases, business receiverships, business torts, matrimonial and family law, trusts and estates, defamation, land use and construction, health law and wage and hour cases. Justice Scheinkman was voted the #1 Arbitrator in the 2021 New York Law Journal “Best Of” Survey.
Rachel Allen brings a diverse skill set and extensive litigation experience to the Derek Smith Law Group. Ms. Allen primarily concentrates on Employment Discrimination and Civil Rights cases. She is a zealous legal advocate and gives each of her clients the time, respect, and consideration that they deserve. Her practice areas include Pregnancy Discrimination, Severance Agreements, Employment Contract, Attorneys Wrongful Termination, Employment Discrimination, and Sexual Harassment. She has extensive experience representing clients in both commercial and civil litigations from inception through trial and even on appeal. In addition to representing individuals, Ms. Allen has successfully litigated several class action lawsuits and managed global settlements on behalf of her clients.
Patrick J. Bannon has extensive experience defending wage-and-hour cases, including class and collective actions, lawsuits brought by overtime-exempt employees who claim they are entitled to overtime pay, claims by independent contractors who allege they are entitled to be treated as employees, and lawsuits brought by employees claiming that they were required to work off-the-clock. Mr. Bannon also helps businesses avoid litigation by advising them about all aspects of their relationships with employees including compensation for exempt employees, non-exempt employees and executives; leaves of absence; discipline and termination; managing employees with physical and mental conditions that affect work; distinguishing employees from independent contractors; noncompetition agreements; employment contracts; separation agreements; and reductions in force. He has helped a number of major clients develop and enforce arbitration agreements.
