CLE Webinar: New Developments in Child Victims Act Cases – 2024 Litigation and ADR Update

When the New York State Child Victims Act was enacted in April 2019, the legislature created a look back window that allowed survivors of childhood sexual abuse to file lawsuits through August 2021. During that look back window, more than 10,000 lawsuits were filed, and are now making their way through the court system. This program will discuss updates in case law, and the use of mediation to resolve these cases.

The Hon. Elizabeth Bonina (Ret.), Danielle Medeiros, Esq., Jordan K. Merson, Esq. and Lewis R. Silverman, Esq., will share their respective views from the mediator, law clerk, plaintiff-counsel and defense-counsel perspectives on the unique concerns in mediating these types of matters, including presuit settlement negotiations, comparison of litigation vs. mediation, discovery, timing, and the ethical considerations for each of these steps and an update on the case law.

The Hon. Elizabeth Bonina (Ret.) is a retired Justice of the Supreme Court, Kings County and is a member of NAM's (National Arbitration and Mediation) Hearing Officer Panel.
