Update From NAM – Re: Virtual ADR and NAM's Security Approach

We hope this finds you well and safe.

As you may know, NAM's transition of in-person mediations and arbitrations to virtual participation has been hugely successful. The majority of the conferences and hearings previously scheduled have switched over to video and tele-conference, and new cases are being submitted on a daily basis for virtual ADR.

NAM's neutrals are resolving cases with the same level of success as in-person hearings. They have been fully trained on the use of NAM's technology. In addition to their very active caseloads, our panel has been busy writing articles and sharing their virtual ADR experiences with our clients. Most recently, Hon. John DiBlasi and Richard Byrne, Esq. hosted interactive webinars on the use of the technology to a “sold-out” group of participants. NAM looks forward to presenting additional webinars on this topic in the near future.

Most importantly, NAM is grateful to you, our clients, for your loyalty and support during this time—we will continue to do everything in our power to assist you so that you can keep your business moving forward.

Recently, you may have seen or heard about press coverage relating to security questions surrounding the use of ZOOM technology.

Please note the following:

  1. With NAM's technology and, specific to NAM, each hearing is separate and apart from any other hearing. The dial-in numbers provided by NAM for each hearing are case specific. As such, participants in one case can not enter the hearing room of another case.
  2. Unlike a public meeting, NAM's neutrals serve as the hosts and have total “control” over the session. The neutral has the ability to immediately isolate and remove any unauthorized participants.
  3. NAM's IT Department monitors each virtual hearing and is readily available to assist at any time should the need arise. This includes monitoring the meeting rooms to ensure that only authorized participants appear.
  4. Invitations which contain the hearing dial-in information are case specific and are ONLY sent to the participating parties. This information is NOT made available to the public.
  5. The NAM neutral controls the content that is shared on screen with the other participants, including documents and/or videos.
