The audience learned from Judge DiBlasi's and Mr. Byrne's wealth of experience as mediators, both who have the depth of knowledge and experience in successfully guiding their clients through the mediation process. Both presenters offered best practices on how to position a case for mediation, tips for successful negotiation and tactics for reaching a settlement.  They also addressed why mediation of commercial disputes has grown in popularity and why parties are increasingly recognizing the benefits of alternative dispute resolution (ADR) to resolve disputes outside of the full adversarial process.

Topics that were addressed included:

  • Preparation for Mediation
  • Pre-mediation Submissions
  • Opening Statements in Mediation
  • Mediating Multi-Defendant Cases
  • Employment of “Defense Only” Mediations
  • Issues Unique to Commercial Mediations
  • Use of Experts at Mediation
  • Identifying Conditions to Settlements Prior to Resolution
